Vietnam: Clarification on assignment letters and reporting

Latest update on clarification on work permit procedures

Following from last month’s Vietnam Circular 40, the Vietnamese authorities have given further details on guidelines to the implementation of Decree 11.

Assignment Letters

For intra-company transferees an assignment letter issued by a shareholder or owner of the Vietnamese host company must be submitted. The rule has changed from previously allowing human resources to issue the letter and may not have been related to the owners or shareholders.

Quarterly Reporting

The new quarterly foreign labour report must include foreign experts or managers that are staying in Vietnam of 30 days or less. A penalty charge will be in place for those who fail to submit the quarterly report.
