On 19th December 2018 the Swiss Federal Council reached an agreement with the United Kingdom (UK) regarding the residency rights of citizens following Brexit. The agreement guarantees the safety of rights for Swiss and UK nationals under the Free Movement of Persons Agreement.
There are two scenarios where the agreement between Switzerland and UK will come into effect:
UK and the European Union agree the UK withdrawal: Brexit will come into effect on 29th March 2019 and there is a provisional transitional period until the end of 2020. During this time the existing agreement of free movement will remain the same. Once the transition period is over, the agreement struck on 19th December 2018 between Switzerland and the UK will come into effect.
UK withdraws from the European Union with a “no deal” agreement: If Brexit is not approved; the UK will leave the European Union on 29th March 2019. This would mean that the agreement struck between Switzerland and the UK on 19th December 2018 would come into effect on 30th March 2019.
