Implementation of European Intra Company Transfer Directive to affect Dutch immigration rules

From November 29 2016, new regulations for the implementation of the EU directive on temporary intra-company transfers (“The ICT Directive”) will come into action.

The new regulations will limit the duration of secondments into the Netherlands from outside EU member states to three years for managers and specialists and to one year for trainees. These time periods are not renewable. These changes will not affect local hires or employees who are currently in the Netherlands and those who already hold a highly skilled migrant permit issued before 29 November 2016. However, this may present difficulties for those planning to arrange secondments to the Netherlands for more than three years.
