Brazil: New rules for the dependent visa process

The Brazilian immigration authorities have now made changes to the criteria and documentary requirements to the dependent visa process. The main change has been in the very definition of the term “dependent”. The qualifying relationships are:

  • Spouses (both opposite and same-sex)
  • Domestic partners (both opposite and same-sex)
  • Children, grandchildren and stepchildren who are economically dependent on the sponsor
  • Parents
  • Grandparents
  • Siblings who are financially dependent on the sponsor
  • Children under legal guardianship

The dependent have to apply at their nearest Brazilian consulate in the country in which they live, or they can apply at the Federal Police Department (if they have entered Brazil with the sponsor/main applicant). Dependents not eligible for a visa waiver must enter Brazil on a visitor visa. The documents that will need to be provided for this application must be legalised/apostilled.

Dependents who are applying as domestic partners will no longer need to provide evidence of the duration of the relationship. The evidence that the domestic partners must submit will differ from case to case but there is no longer the requirement to prove the relationship has lasted for longer than a year (which was the previous legislation guideline).
