Australia: Labour Market Testing Exemption

In Australia, the Labour Market Testing requirement is mandatory for the Temporary Skilled Shortage Visa (TSS) visa subclass 482 unless the applicant is exempt. This exemption has now been expanded and now Intra Company Transfers are now considered in this exemption.

The Labour Market Test exemption will include the following situations:

  • Where the foreign national works within the same group of companies overseas and transfers to the Australian business entity
  • Where the foreign national works in a profession and is internationally recognised as an exceptional contributor to the profession. This can include sport, research or academia
  • Where the foreign national earns equal to or more than $250’000 AUD
  • Where the foreign national works in the medical field (GP, Medical Practitioner, Ambulance officers and Paramedics)
