From 1st July 2018 all employers who wish to hire foreign nationals in occupations that have an unemployment rate of 8% or above, must undertake a resident labour market test.
Each position must be registered with the relevant employment office via email, phone or in person. The employment office will advertise the position online for five days. During this period the employer is prohibited from advertising the role publically. The employment office will contact the employer and submit a list of promising candidates, usually within three days. The employer can then review and confirm which candidate is suitable for interview.
If employers do not wilfully adhere to the above regulations they will be punished by way of a 40’000CHF fine. In the case of negligence, the penalty can be up to 20’000CHF.
