South Africa: Draft Immigration Regulations published

The Department of Home Affairs has released new draft immigration regulations that will introduce changes to some visa categories and relax the documentary requirements for travelling minors. The draft includes the following details:

  • For Critical Skills Visas the list of critical skills occupations (which can be filled by foreign national workers) will be revised and is expected to exclude general management and IT related positions. This is to limit the list of what is deemed a Critical Skill
  • General Work Visa decisions will be sent directly to the sponsoring employer
  • Corporate Visa decisions will be sent directly to the sponsoring employer
  • Unmarried Couples are still required evidence that the relationship of the unmarried couple will need to be evidenced in the immigration application. The relationship will have to have existed for the last 2 years
  • Travelling minors have had the rules relaxed. Generally, foreign minors who are travelling to South Africa will not generally need to carry their birth certificate so long as their passport contains information on the parental relationship. When one parent is travelling with the child, they will need to provide a letter stating the other parents’ consent to the travel
