Poland: Exemptions from Labour Market Testing

From 1st July 2018 new legislation in Poland allows non EU nationals to apply for work permits for 197 occupations without the need to obtain confirmation from the regional Labour Office.

Previously, for a foreign national to commence work, the Polish host company would have to submit an application / notification of the job vacancy to the regional Labour Office. The Labour office will check if there are any Polish nationals or EU Citizens that can be found to fill the available role and commence market searches. If there are no suitable candidates found within 21 days, the approval for the foreign national will be awarded.

The exemptions include (but are not limited to) the following expertise fields:

  • IT Specialists
  • Constructions Workers
  • Electrical Engineers
  • Lorry Drivers
  • Doctors
  • Nurses
