Finland: Amendments in resident permit applications and new requirements

Amendments in resident permit applications; and new requirements for posted worker notification

The time limit for residence permit and registration of EU applicants to provide identification and submission of original documents has been increased to three months, from the original one month timeframe. This also applies to anyone who applied online before 10 November 2016 and has not provided any identification. Applicants who submitted in Finland will have to provide their Identification at a Finnish Police station before the end of 2016 and a service point at the Finnish Immigration Services at the beginning of 2017. Those who have applied aboard will need to book an appointment with the Finnish Mission to provide proof of their identification.

For residence permit, EU registration or Finnish citizenship via the e-service Enter Finland applications, applicants will need to prove their identification in person, it is then the application will be put into a processing queue.

From 1 January 2017 the Finnish Immigration Service will be responsible for accepting applications for residence and citizen permits, however the police will still be accountable for visa extensions applications.

Applications can be submitted via the online e-service and appointments can be booked at Finnish Immigration service points from 1 January.

Also all overseas employers sending employees to work in Finland on a temporary basis will need to notify the Occupational Safety and Health Administration (OSH) in Finland before work begins. This includes companies based inside and outside the EU that are sending employees to Finland under a service contract, intercompany transferee within the same group of companies or as a temporary agent worker. This is not applicable if the employees are within the same company groups for a maximum of five days, except when the company operates in the construction sector.

Any significant changes during the assignment must be communicated immediately and should any companies fail to achieve reporting duties they will face a penalty fee.
