European Union: Posted Worker Reform has been implemented

On 29th May 2018, the European Parliament voted in favour of implementing changes to the “Posting of Workers Directive (1996/71/EC). All European Union member states will have two years in which to transfer and enforce the new rules into their national law.

The changes associated with the Posted Worker Reform are as follows:

  • The host country’s remuneration rules will apply to all foreign posted employees
  • Travel and accommodation costs will need to be borne by the employer and not taken from the worker’s salaries
  • Employers must ensure that the accommodation conditions for posted workers are to a high standard
  • The new rules will apply to job assignments up to twelve months (with a possible six month extension) after which all of the host countries labour regulations will apply to the assignment
