Belgium: New Requirements for Posting Workers

Latest news on the new Belgium requirements for posting workers.

Belgium implemented EU Directive 2014/67 concerning the posting of workers in the framework of the provision of services.

Effective since 1 January 2017, The Act of 11 December 2016 requires companies posting workers to Belgium to assign a representative to liaise with authorities. The representative will need to retain (in paper or electronic form) for one year after the assignment ends certain documents related to the posting and provide them to the authorities upon request. These documents will include a copy of the assignment letter, time sheets, salary slips and proof of payment of wages.

There will be financial penalties introduced for non-compliance of documentary and representative requirements within the new Act.

The existing system “LIMOSA declaration” which informs the Belgian labour authorities of postings still remains in effect.
