Australia: New Subclass 482 – Temporary Skilled Shortage (TSS) Visa

Latest update in Australia regarding the New Subclass 482 – Temporary Skilled Shortage (TSS) Visa

The Temporary Skilled Shortage Visa will come into effect on March 18th, 2018 and replace the current 457 visa in Australia. There are three main categories of the Subclass 482 visa:

Short-term stream: Workers whose occupations are on the Short-term Skilled Occupation List will be able to work in Australia for a maximum of two years

Medium-term stream: Workers who occupations are on the Short-term Skilled Occupation List will be able to work in Australia for a maximum of four years

Labour agreement stream: Overseas workers can be employed under a labour agreement with the Commonwealth Government, if there is a need that cannot be met by the Australian labour market

Qualifying Criteria

  • Primary applicants must have at least two years relevant work experience
  • The English language requirement for applicants will remain at 4.5 IELTS or equivalent
  • The English language requirement for applicants under the Medium-term stream will require a higher level of English proficiency of at least five in each band on the IELTS test or equivalent

Application Charges

  • The visa application charge for the TSS Short-term stream will be $1150
  • The visa application charge for the TSS Medium-term stream will be $2400

Healthcare criteria

The health criteria are going to more stringent. Where applicants have a health problem and would otherwise fail the health exam, the sponsor can no longer sign a health undertaking. The applicant will need to show that they will not impose an undue burden on the Australian health system.

Points to note

  • If the occupation of the visa holder is going to change then a new nomination and new visa must be lodged and the associated fees must be paid
  • The TSS visa can be cancelled if the applicant ceases to have a “genuine intention” to work in the position
  • TSS visas are only applicable and available for full time positions
  • Employers must notify the Australian Immigration Authorities if any TSS holder fails to commence employment per the employment agreement
